Copyright
Copyright is a form of protection provided to the authors
of “original works of authorship,” including literary, dramatic,
musical, artistic and certain other
intellectual works.
The copyright registration has a declaratory and non-constitutive
character. Authors' title to authorship
originates from and together
with the very same creation of every new work, not from the filing
of a copyright application.
Even though registration is not a requirement for protection, the
copyright law provides several inducements or advantages to
encourage copyright owners to make registration,
insofar as the
filing certificate is and remains, a prima facie acknowledgement of
authorship, and secondly it allots an official date to that acknowledgement,
so that the challenger or violator finds himself charged with the burden
of proving an earlier date.
